Acceptance of the Terms of Service

AIT offers services and products which are provided by AIT-Edtech, AIT TR Inc., AIT Technology School, AIT TR GmbH, AIT TR Inc. (Canada), our parents, subsidiaries and affiliates (collectively “AIT”, “we”, “us”, “our”).

These Terms of Service (“Terms”) are a binding legal agreement between you and AIT which govern your access to and use of our websites at www.ait-edtech.com, ait-tr.ca, other websites that are operated by us and apps and services offered by us (collectively the “Service”).

By using the Service or by clicking to accept the Terms you accept and agree to be bound and comply with these Terms and our policies referenced in these Terms.
 

Definitions

In these Terms:

  • “Faculty” means AIT employees and contractors engaged in teaching, research or administrative roles.

  • “Student” means individuals enrolled in courses or programs offered by AIT.

  • “Submit” includes submit, post, publish, display, or transmit.

  • “User” means any Student, Faculty or other user of the Service.

  • “User Content” means any content, material and other information submitted by a user to the Service.

Our Service

The Service enables you to obtain educational services such as the enrollment in courses, application for educational grants or subsidies, and access to, and acquisition of, related administrative materials and services from AIT.

Who May Use Our Service

You may only use the Service if: (a) you are at least 16 years of age; and (b) you comply with applicable law, these Terms and our policies which include the Acceptable Use Policy and such other policy as we may implement from time to time (the “Policies”).

If you violate the Terms or any Policies, we may, in our sole discretion terminate or suspend your access to the Service.

User Account

Faculty, Students and other Users may create or be provided with an AIT account to access certain features and services. You agree that you must comply with our Acceptable Use Policy when using your account. You agree that as a condition to use of the Service you are required to provide us with accurate and complete information and to update such information as necessary from time to time. We reserve the right at any time to disable, suspend or terminate your account, username, password, or other credentials for any reason, including for any violation of any provision of these Terms or any Policy.

Modifications to the Terms of Service and to the Service

We reserve the right, in our sole discretion, to revise and update these Terms and Policies at any time. Any and all such modifications are effective immediately upon posting. You agree to periodically review these Terms and Policies. Your continued use of the Service shall be your acceptance of any modification. Any information concerning the Service may be changed, withdrawn or terminated at any time without notice.

Intellectual Property Rights and Ownership

You understand and agree that the Service, including the AIT-Edtech platform and its entire contents, features, and functionality, are owned by AIT and/or its licensors. We reserve all intellectual property rights (copyright, trademarks, domain names, design rights, patents). Nothing in these Terms grants you any rights in the Service other than as necessary to access the Service for educational purposes.

User Content: Grant of License

By submitting any User Content to the Service, you grant us a world-wide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, and modify said content. You declare that you own or have the necessary rights to submit the User Content. AIT has the right, without notice, to remove or refuse to post any User Content for any reason. We may take legal action, including referral to law enforcement, for any illegal or unauthorized use of the Service.

Payment, Grants, and Refunds

This Service may enable you to purchase services or apply for educational subsidies.

  • Subsidies: Eligibility for grants or subsidies offered through AIT-Edtech is subject to individual evaluation and internal AIT criteria. Applying for a grant does not guarantee its approval.

  • Purchases: May be subject to additional terms provided at the time of transaction.

  • Refunds: Purchases are non-refundable. While AIT reserves the right to offer refunds in its sole discretion, it has no obligation to provide any refund or credit of any kind.

Third Party Content and Services

This Service may include content provided by third parties. AIT is not responsible or liable to you, or to any third party, for the content or accuracy of any third-party materials. Links to third-party services are provided for convenience only; you access them at your own risk.

Security

We use physical, electronic and administrative measures to secure your personal information. However, the safety of your information also depends on you. Any transmission of personal information is at your own risk. If your account is compromised, you must notify us immediately at info@ait-edtech.com.

Disclaimer of Warranties

Your use of the Service is at your own risk. The Service and its content are provided on an "as is" and "as available" basis without any warranties of any kind. AIT does not warrant that the Service will be accurate, error-free, or uninterrupted, or that defects will be corrected.

Limitation on Liability

To the maximum extent permitted by law, AIT and its affiliates shall not be liable for any direct, indirect, special, incidental, or consequential damages arising out of your use or inability to use the Service. In no event shall our aggregate liability exceed the greater of (a) the total amounts you paid to us in the six (6) months prior to the action, or (b) One Hundred US Dollars ($100.00).

Indemnification

You agree to defend and indemnify AIT and its affiliates from and against any claims, liabilities, or expenses (including legal fees) arising out of your breach of these Terms or your use of the Service.

Dispute Resolution and Arbitration

In the event of a Dispute, the parties shall first try in good faith to settle it via written notice. If unresolved after 30 days, the Dispute shall be determined exclusively by binding arbitration conducted in the city of Aventura, Florida, by a single arbitrator.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida and the federal laws of the USA. Subject to the arbitration provision, the parties submit to the exclusive jurisdiction of the courts of the State of Florida.
